TERMS AND CONDITIONS

LionHouse – Property Experts of 54 Meadowbush Court, Brampton, ON (Hereinafter called the Contractor). 

This membership agreement is entered into between LionHouse Property Experts  and the Member named below and incorporates the terms and conditions listed and any rules stipulated by the company or its representative from time to time. This agreement is the exclusive agreement between the Company and Member and Member affirms that the Member has not relied upon representations or warranties not contained herein.

IT IS HEREBY AGREED that: 

  1. Subscription to LionHouse Property Experts Services 
  • Gold Package  – Annual Subscription
  • 6 service calls per year 
  • a max of 1.5 hours per call (9 hours of labour)
  • 2 jobs max per Service call
  • 50 point – Spring & Fall Property Inspection
  • Members save on assessment fees
  • Up to $100 of material included Annually
  • Insured Company
  • Members Save on Major Renovations (5% for Gold members)

Gold Package Price: Pricing  $999/annually ($1640 value)

  • Platinum Package – Annual Subscription
  • 14 service calls per year, and can be combined upto 3 service calls per single day 
  • a max of 1.5 hours per call 
  • 2 jobs max per Service call
  • 50 point – Spring & Fall Property Inspection
  • Up to $150 of material included annually
  • Insured Company
  • Members save on assessment fees
  • Members Save on Major Renovations (10% for Platinum members)
  • Urgent calls will be prioritized (e.g. leaks or water issues) 
  • Can be used for up to  2 properties.

Platinum Package Price –  $1899/annually ($3130 Value) 

  1.   TERMS AND CONDITIONS The Contractor agrees to provide Client Member with membership of the specified membership Package selected above and the Member agrees to pay for such membership and otherwise abide by the terms and conditions.
  1. The Contractor shall carry out and complete all works indicated in the schedule to this contract in good  substantial and workmanlike manner. 
  2. The Contractor shall complete the works within 24-72 hours of the scheduled appointment time or the time specified under the Contract Period, or any  such extension of time as may be agreed upon by the Client Member thereafter. 
  3. Any works not included in the schedule of works shall be deemed to be VARIATIONS TO CONTRACT and  all terms and conditions of the original contact shall apply.
  4. Each project will be assessed for scope of work prior to the start, and if the work is outside the 1.5 hours  limits of the service call, a quote will be provided. 
  5. Customers must declare the intended purpose of each service call, this will enable assignments to the appropriately skilled technician or tradesperson. As well, will allow the contractors to bring the appropriate tools for the specific job as well as allow time management and scheduling. 
  6. Additional services cannot be added during a service call unless authorized by the scheduler/ head office / dispatch. 
  7. Each job will be different – Refer to the guide provided, if there are multiple trades persons/ skills required will be charged as multiple service calls.
  8. Materials can be purchased by the customer or will need to be paid for at the end of each service call
  9. Client Members will need to sign a waiver at the end of each service call, if not present our office will reach out to confirm and get sign off on each service call.
  10. The Client Member shall extend the Contract period by a fair and reasonable amount of time if the Contractor: 
    1. Has to spend extra time on the work as a result of variations in the schedule of work. 
    2. Cannot finish on time for reasons beyond his control, including any delays caused by the Client Member. 
  11. 2 services calls carry over upon renewal if package was not used at all during the previous subscription period
  1. VARIATIONS TO THE CONTRACT
  1. The Client Member reserves the right to vary the contract, during the period of this Contract and it is only the Client Member that can change the work details of this Contract. Changes must be in consultation with the Contractor and be within the range of services offered through the subscription – see Appendix A. Projects outside the scope of the subscription will be considered and quoted separately.
  2. The Contractor is bound to carry out any such variations as directed by the Client Member. The Client Member agrees to  reasonably compensate the Contractor for any additional labour required of the Contractor as a result of  variations made by the Client Member if said services are over and above the chosen subscription package. 
  3. The same terms and conditions of payment under this contract apply to Variations of Contract. 
  1. SUB-CONTRACTING

Sub-contracting of the works is permitted without prior the consent of the Client Member. 

  1. MATERIALS
  1. All materials supplied by the Client Member shall remain the property of the Client Member.
  2. Where the Contractor supplies materials and the Contract does not include the supply of the same,  the Contractor shall provide invoices to show the extent of supply and the Client Member is bound by this  contract to reimburse the Contractor in the sum stated on the invoices submitted. 
  1. TERMINATION OF THE CONTRACT
  1. The Client Member may terminate this Contract if the Contractor: 
    1. is absent regularly in the performance of his contractual obligations; or 
    2. does not meet the agreed date of completion; or 
    3. is incompetent or negligent in the execution of his contractual obligations; 
    4. if the works executed are of an unacceptable quality and standard and the Contractor does not correct the matter upon notice of the same. 
  2. The Contractor may terminate this Contract if the Client Member: 
    1. fails to pay any amount due, without giving a reasonable explanation.
    2. prevents or obstructs the Contractor from the performance of his contractual obligations 
    3. does not provide access to the property to complete the services
  1. EFFECT OF TERMINATION ON COMPENSATION
  1. In the event that the Client Member terminates the Contract, he will be obligated to pay the sums due to the  Contractor for that part of the work completed. 
  2. In the event that the Contractor terminates this Contract, the Client Member will be obligated to pay for the  works properly executed.

Appendix A – Installation/Replacement/Upgrades/Repairs

This Schedule of Works shall be drafted according to the scope of works agreed upon by the Contractor and  Client Member and as such will vary for each job and will be registered prior to each service call visit.

Appendix B – Quote for Renovation and Major Projects

 

The Client Member agrees to pay to the Contractor the Total sum of additional work quoted, as follows: 

  1. 10% of the total price upon the signing of this contract; and 
  2. 60% of the total price upon 50% completion of the contracted work; and 
  3. 30% of the total price upon 100% or full completion of the works in accordance with the terms and conditions of this Contract. 

This membership entitles the Client member to a member discount in accordance with their membership package. 

  1. 5% For Gold Package 
  2. 10% For Platinum Package 

*When signing up for memberships it does not include major projects and renovations only what was agreed upon in the selected membership package. Major projects and renovations aren’t automatically included in the membership package. If the client members project has to do with any of the following listed below then additional quotes are required. only members will receive a 5-10% discount as stated below:
